1. Agreement to Terms 条款同意

By accessing or using the babak.my website and services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services. These Terms apply to all visitors, users, and clients of our website and services.

babak.my is an IT services agency providing consulting and development services, including but not limited to:

Some Services are one-off project engagements; others (such as hosting and VPS plans) are ongoing subscriptions billed on a recurring cycle. Section 7 and our separate Refund & Cancellation Policy describe how payment and cancellation work for each.

4. AI Assistant Usage AI助手使用

Our AI Assistant is provided for informational purposes only. By using it, you understand that:

• Responses are AI-generated and may not always be accurate or current 响应是AI生成的，可能并不总是准确或最新的
• You must not submit sensitive information such as passwords or full payment card details in the chat 您不得在聊天中提交密码或完整付款卡信息等敏感信息
• Usage limits may apply to ensure fair access 可能适用使用限制以确保公平访问
• The AI Assistant cannot make a binding quotation, commitment, or contract on our behalf — for those, use our contact form AI助手不能代表我们做出具有约束力的报价、承诺或合同——如需此类事项，请使用我们的联系表

5. Project Engagements 项目合作

Quotations provided through our website or AI Assistant are estimates only and are subject to a detailed requirements review and a written Service Agreement before work begins. That Service Agreement (not this page) governs the specific scope, timeline, milestones, payment schedule, and intellectual property terms for a given engagement.

通过我们网站或AI助手提供的报价仅为估算值，须经过详细的需求审查，并在工作开始前签订书面服务协议。该服务协议（而非本页面）规定了特定合作的具体范围、时间表、里程碑、付款计划和知识产权条款。

Unless a Service Agreement says otherwise: custom code and designs created for a client transfer to the client upon full payment; third-party components remain under their own licenses; and we may showcase completed work in our portfolio unless the client has asked us not to.

除非服务协议另有约定：为客户创建的定制代码和设计在全额付款后转让给客户；第三方组件保留其各自的许可条款；除非客户要求不予展示，否则我们可能在作品集中展示已完成的作品。

6. Intellectual Property 知识产权

The website content, design, logos, and materials on babak.my are owned by us and protected by intellectual property laws; you may not reproduce, distribute, or create derivative works from them without our written permission. Intellectual property for client project work is addressed in Section 5 above and in the applicable Service Agreement.

7. Subscriptions and Recurring Services 订阅与循环服务

Hosting, VPS, and other recurring services renew automatically at the end of each billing cycle unless auto-renewal is turned off or the subscription is cancelled beforehand. We send renewal reminders ahead of each renewal date. See our Refund & Cancellation Policy for how cancellation and billing-cycle refunds work.

托管、VPS及其他循环服务将在每个计费周期结束时自动续订，除非提前关闭自动续订或取消订阅。我们会在每个续订日期前发送续订提醒。有关取消和计费周期退款的详情，请参阅我们的退款与取消政策。

8. Payment Terms 付款条款

• Invoices are issued in the currency stated on the invoice (typically USD or MYR) and are payable by the due date shown 发票以发票上注明的货币（通常为美元或马币）开具，并应在注明的到期日前付款
• Card payments are processed securely through Stripe 卡付款通过Stripe安全处理
• Late payment may result in suspension of active services or projects until the account is settled 逾期付款可能导致暂停正在进行的服务或项目，直至账户结清
• Prices shown in Malaysian Ringgit (MYR) alongside a US Dollar (USD) price are provided for reference only; the invoiced currency and amount govern 与美元价格并列显示的马来西亚令吉（MYR）价格仅供参考；实际以发票货币和金额为准

9. Limitation of Liability 责任限制

To the maximum extent permitted by law: our Services are provided on an "as is" and "as available" basis without warranties of any kind; we are not liable for indirect, incidental, or consequential damages; and our total liability for any claim relating to a Service shall not exceed the amount you paid us for that specific Service in the twelve (12) months preceding the claim.

在法律允许的最大范围内：我们的服务按"现状"和"可用"basis提供，不提供任何形式的保证；我们不对间接、附带或后果性损害负责；我们对任何与服务相关索赔的总责任，不超过您在索赔发生前十二（12）个月内为该特定服务向我们支付的金额。

10. Indemnification 赔偿

You agree to indemnify and hold babak.my harmless from any claims, damages, or expenses arising from your violation of these Terms, your use of the Services, or your violation of any third party's rights.

您同意赔偿并使 babak.my 免受因您违反这些条款、使用我们的服务或侵犯任何第三方权利而引起的任何索赔、损害或费用。

11. Termination 终止

We may suspend or terminate access to our Services for a violation of these Terms, non-payment, or misuse of our systems. We may also modify or discontinue a Service, giving reasonable notice where practical.

我们可能因违反这些条款、未付款或滥用我们的系统而暂停或终止对服务的访问。我们也可能修改或终止某项服务，并在切实可行的情况下给予合理通知。

12. Governing Law 适用法律

These Terms are governed by the laws of Malaysia. Any dispute arising from these Terms or our Services shall be subject to the courts of Malaysia, without prejudice to any mandatory consumer-protection rights you may have under the law of your own country of residence.

这些条款受马来西亚法律管辖。因这些条款或我们的服务引起的任何争议均应受马来西亚法院管辖，但不影响您根据您居住国法律可能享有的任何强制性消费者保护权利。
